Court Throws Out VeryDarkMan’s Objection In Falana And Falz’s ₦1 Billion Defamation Case
A Lagos High Court has dismissed a preliminary objection filed by controversial social media commentator, Martins Vincent Otse, popularly known as VeryDarkMan (VDM), in the ₦1 billion defamation lawsuit brought against him by renowned human rights lawyer, Femi Falana (SAN), and his son, award-winning musician Folarin Falana, aka Falz.
Justice F. Azeez delivered the ruling on Tuesday, May 20, declaring that VDM’s application lacked merit. As a result, the judge ordered him to pay ₦200,000 in legal costs—₦100,000 each to Femi and Folarin Falana.
The judge also instructed VDM to promptly file his defence in the suit.
The legal action stems from a video VDM posted on his Instagram account (@verydarkblackman) on September 24, 2024. In the video, he allegedly made damaging and defamatory statements about the Falanas. They are each seeking ₦500 million in damages, totaling ₦1 billion, over what they describe as a deliberate attempt to tarnish their reputation.
At the hearing, Femi Falana was represented by legal counsels Ernest Olawanle and Femi Akinyemi, while Falz appeared in person. Although VDM was not in court, his lawyer, Marvin Omorogbe, stood in for him.
The Falanas argue that the remarks made in the video were libellous, scandalous, and defamatory. They are requesting the court to declare the publication defamatory and to issue a perpetual injunction preventing VDM, his agents, or affiliates from making or spreading similar claims in the future.
