Hunter Biden Sues Fox News Over Nude Photos Featured In Miniseries

Biden alleged in the suit the miniseries—which was taken down after he threatened to sue in April—unlawfully disseminated intimate images and video of him without his consent in order “to humiliate, harass, annoy, and alarm (him) and to tarnish his reputation.”

The complaint, which names Fox News Network and Fox Corporation as defendants, also alleged the dissemination of the images caused Biden “severe emotional distress, humiliation, and mental anguish” and irreparably injured his reputation both personally and professionally.

Biden is also suing for intentional infliction of emotional distress and unjust enrichment, saying the show unlawfully exploited his “name, image, and likeness for Fox’s commercial benefit.”

Biden is seeking compensatory damages, punitive damages, an order forcing Fox to take down any remaining publication of the intimate images and destroy any copies it owns, a permanent injunction preventing Fox from using the images again and disgorgement of the profits from the miniseries.

The law firm representing Biden did not respond to a request for comment but confirmed the complaint was filed Monday, and Fox did not immediately respond to a request for comment.

“Defendants’ conduct was so egregious and done so clearly with malice and/or reckless indifference to Mr. Biden’s interests, wellbeing, and reputation that in addition to all the damages which Mr. Biden is entitled to, Defendants should also be required to pay punitive damages to punish them for their intentional conduct and to deter Fox and others similarly situated from engaging in such reprehensible conduct in the future,” the complaint read.

“This entirely politically motivated lawsuit is devoid of merit. The core complaint stems from a 2022 streaming program that Mr. Biden did not complain about until sending a letter in late April 2024,” Fox News said in a statement to Forbes. “The program was removed within days of the letter, in an abundance of caution, but Hunter Biden is a public figure who has been the subject of multiple investigations and is now a convicted felon. Consistent with the First Amendment, FOX News has accurately covered the newsworthy events of Mr. Biden’s own making, and we look forward to vindicating our rights in court.”

Fox Nation began streaming “The Trial of Hunter Biden”—which it described as “a riveting look at the unresolved legal situation of President Joe Biden’s son, Hunter”—in October 2022, according to the lawsuit. The mock trial sought to answer questions tied to two charges: whether Biden violated the Foreign Agents Registration Act and whether he committed bribery, though Biden has not been charged with either crime. Fox took down the six-part series earlier this year after Biden threatened to sue, though Monday’s suit alleges Fox did not remove “promotional reels and clips” from the series that are still available and that the show is still available for streaming on other third-party platforms. Biden—who was recently convicted on three federal felony gun charges—has been a target of Republicans since 2020 when Joe Biden ran for president. Investigations by Republican lawmakers into the Bidens’ foreign business interests have not yielded any concrete evidence proving President Biden engaged in illegal or unethical behavior relating to Hunter Biden’s business ventures. Hunter Biden has been separately charged by federal prosecutors in California with nine counts related to his alleged failure to pay $1.4 million in taxes in the late 2010s.
