Lawyer sues Chief of Army Staff, Buratai over Nnamdi Kanu's alleged disappearance

Ifeanyi Ejik, lawyer to Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB) has sued the Chief of Army Staff, Lieutenant General Tukur Buratai over Nnamdi Kanu’s alleged disappearance since a reported September 14, 2017 raid by the Army on his residence.

In an originating motion filed before the Federal High Court in Abuja, Ejik wants the court to give an order mandating General Buratai to produce Kanu in court on his next adjournment date for the criminal trial he is facing in October. The motion has the IPOB leader as the only applicant and the Chief of Army Staff as the only respondent.  

According to the application, the grounds for the relief include that the Kanu was, before he went missing, known to have lawfully exercised his constitutional right of freedom of association, peaceful assembly and self-determination.  

The application also said Kanu was still enjoying the bail granted him by the court, when the prosecution in his trial requested the court to revoke the bail.  It also accused the Nigerian Army of acting under express command purportedly handed down by Buratai, and violently invaded the applicant’s home in Afara Ukwu Ibeku in Umuahia in Abia State.
